Terms and Conditions — St. Petersburg Pavers

These Terms and Conditions (“Terms”) govern your use of stpetersburgpavers.com (the “Site”) and services provided by St. Petersburg Pavers (“St. Petersburg Pavers,” “we,” “us,” or “our”).
By using the Site, requesting an estimate, accepting a proposal, scheduling work, or purchasing services, you agree to these Terms where applicable.
A project-specific estimate, proposal, contract, or change order may contain additional terms. If project-specific written terms conflict with these general Terms, the project-specific agreement will control with respect to that project.
1. Services
St. Petersburg Pavers provides paver, hardscape, outdoor improvement, repair, and maintenance services.
Services may include:
- Paver installation;
- Concrete pavers;
- Brick pavers;
- Natural stone and travertine installation;
- Driveway installation;
- Patio installation;
- Pool deck installation;
- Walkways;
- Hardscape installation;
- Retaining walls;
- Outdoor kitchens;
- Fire pits;
- Decorative driveways;
- Custom paver patterns;
- Commercial and industrial paving;
- Paver repairs and leveling;
- Cleaning and sealing;
- Drainage improvements; and
- Related outdoor construction services.
Availability depends on project requirements, location, materials, equipment, staffing, permitting requirements, and other circumstances.
2. Estimates
We may provide free consultations or estimates based on information available at the time.
Unless expressly identified as a fixed-price contract, an estimate is based on anticipated labor, materials, dimensions, access, site conditions, and project scope.
Pricing may change if:
- Actual measurements differ;
- The customer changes the project scope;
- Additional excavation is required;
- Unexpected base or soil conditions are discovered;
- Drainage problems are discovered;
- Underground obstructions are encountered;
- Additional materials or labor are required;
- Material prices or availability materially change before acceptance;
- Permit or regulatory requirements change the work required; or
- Other concealed or unexpected site conditions are discovered.
Material changes will be communicated where reasonably practicable before additional work is performed.
3. Proposals and Project Scope
The specific work included in a project is determined by the accepted estimate, proposal, contract, plans, specifications, or change orders.
Services, materials, or work not identified in the agreed project scope are not included unless subsequently agreed.
Customers should review all project specifications before authorizing work.
4. Deposits and Payment
Projects may require a deposit before materials are ordered or work is scheduled.
Payment schedules, deposit amounts, accepted payment methods, and final payment requirements will be specified in the applicable proposal or agreement.
Customers agree to make payments when due.
Additional work requested or authorized after the original agreement may result in additional charges.
5. Financing
Financing may be available through third-party financing providers.
Approval, interest rates, payment terms, credit requirements, and other financing conditions are determined by the applicable provider.
St. Petersburg Pavers does not guarantee financing approval and, unless expressly stated otherwise, is not the lender.
6. Scheduling
Project dates and completion estimates are provided in good faith but may be affected by circumstances outside our reasonable control.
Potential delays include:
- Rain or severe weather;
- Hurricanes or tropical storms;
- Excessive ground saturation;
- Material shortages;
- Supplier delays;
- Equipment failure;
- Permit or inspection delays;
- Unforeseen site conditions;
- Utility issues;
- Changes requested by the customer; and
- Other circumstances beyond our reasonable control.
We will make reasonable efforts to communicate significant delays.
7. Customer Responsibilities
The customer agrees to:
- Provide accurate property and project information;
- Provide reasonable access to the work area;
- Remove or protect personal property from work areas;
- Secure pets and restrict access by children where appropriate;
- Identify known irrigation systems, underground improvements, private utilities, septic systems, drainage systems, landscape lighting, and similar features;
- Obtain approvals from homeowners’ associations or property owners where required;
- Provide requested selections and decisions in a timely manner; and
- Make payments according to the agreed schedule.
8. Property Access
The customer authorizes reasonable access to the property for personnel, vehicles, machinery, material delivery, excavation, installation, cleanup, inspection, and related project activities.
Paver and hardscape construction may require skid steers, compactors, saws, trailers, trucks, excavation equipment, and other machinery.
Customers should inform us in advance about fragile driveways, landscaping, irrigation systems, underground improvements, limited access, or other conditions requiring special precautions.
9. Underground Utilities and Concealed Conditions
Before excavation, applicable utility-location procedures may be used where required.
However, standard utility-location services may not identify privately installed systems such as:
- Irrigation lines;
- Landscape lighting;
- Private electrical lines;
- Pool equipment lines;
- Drainage pipes;
- Septic components;
- Invisible fencing;
- Private water lines; or
- Other non-public underground improvements.
Customers are responsible for disclosing known private underground systems.
Unexpected underground or concealed conditions may require a change in scope, additional work, or additional charges.
10. Site Conditions and Drainage
Florida properties may experience shifting soil, heavy rainfall, erosion, tree-root activity, groundwater conditions, and drainage problems.
We use reasonable installation methods appropriate for the agreed project. However, conditions outside the installed area or changes occurring after installation may affect paver surfaces.
Where drainage improvements are included, the scope will be described in the project agreement.
Unless expressly included, a paver installation does not constitute a comprehensive engineering, flood-control, or stormwater-management solution.
11. Materials and Natural Variations
Pavers, brick, concrete products, travertine, limestone, marble, slate, natural stone, sand, sealers, and other construction materials may vary in:
- Color;
- Texture;
- Pattern;
- Shade;
- Dimensions;
- Surface characteristics; and
- Natural markings.
Such variations are normal and are not necessarily defects.
Natural stone in particular may contain unique variations, veining, pores, texture differences, and color changes.
Samples, photographs, displays, and website images are illustrative and cannot guarantee an exact appearance.
12. Material Availability and Substitutions
Specific materials, colors, patterns, or products may become unavailable or delayed.
If this occurs, we will make reasonable efforts to provide alternatives for customer approval.
Material substitutions that materially change the agreed appearance or specifications will not be made without appropriate authorization.
13. Change Orders
Changes requested after a project has been approved may affect price and completion time.
Changes may include:
- Expanding or reducing project dimensions;
- Changing paver materials;
- Changing patterns or designs;
- Adding walls, steps, drainage, borders, or other features;
- Additional excavation;
- Additional repairs; or
- Work arising from unforeseen conditions.
Material changes should be documented and approved before the additional work is performed where reasonably practicable.
14. Permits and Approvals
Certain projects may require building permits, right-of-way approvals, HOA approval, inspections, engineering, or other governmental or private authorization.
Responsibility for obtaining and paying for permits or approvals will be determined by the project agreement.
Customers remain responsible for providing accurate ownership information and obtaining approvals specifically assigned to them.
15. Paver Repairs
Repair and leveling services are intended to correct identified problem areas.
Existing pavers may have fading, wear, staining, discontinued colors, or other characteristics that make exact matching difficult or impossible.
We do not guarantee that replacement pavers will perfectly match older existing materials.
Repairs to one area also cannot guarantee that unrelated areas will not settle, shift, crack, or deteriorate in the future.
16. Cleaning and Sealing
Cleaning and sealing can improve appearance and provide additional surface protection, but results depend on:
- Paver age;
- Existing stains;
- Previous coatings or sealers;
- Material condition;
- Weather exposure;
- Drainage; and
- Maintenance history.
Not all stains or discoloration can be completely removed.
Sealers wear over time and may require periodic reapplication.
17. Trees and Roots
Tree roots can cause pavers to lift, shift, or become uneven.
Where roots are present, we may recommend repair, root management, drainage improvements, or other corrective work.
We cannot guarantee that tree or plant roots will not continue growing or cause future movement after work is completed.
Customers may need to consult an arborist regarding significant root systems.
18. Weather and Natural Conditions
Outdoor construction is affected by weather and environmental conditions.
Rain, heat, humidity, hurricanes, flooding, soil movement, erosion, salt exposure, vegetation, and other natural conditions may affect schedules and long-term surface performance.
We are not responsible for damage caused solely by severe weather, flooding, natural disasters, or other events outside our reasonable control.
19. Workmanship and Satisfaction Representations
We stand behind our workmanship and aim to complete projects to the agreed specifications and reasonable professional standards.
Any specific workmanship warranty or satisfaction guarantee applicable to a project should be interpreted according to the written warranty or project agreement provided to the customer.
A satisfaction representation does not require unlimited additional work, changes outside the agreed scope, or correction of conditions caused by misuse, lack of maintenance, natural events, third parties, or conditions outside our control.
20. Maintenance
Proper maintenance helps extend the life and appearance of paver surfaces.
Depending on the installation, recommended maintenance may include:
- Regular cleaning;
- Weed management;
- Joint-sand maintenance;
- Periodic sealing;
- Drainage maintenance;
- Prompt repair of settlement; and
- Avoiding inappropriate chemicals or excessive loads.
Failure to reasonably maintain a surface may affect the availability of warranty remedies where permitted by law and stated in the applicable warranty.
21. Customer-Supplied Materials
If we agree to install customer-supplied materials, the customer is responsible for their suitability, quantity, condition, and availability unless otherwise agreed.
We are not responsible for manufacturing defects or failures inherent in customer-supplied products.
22. Completion and Inspection
Customers should inspect completed work promptly and notify us within a reasonable period of any apparent concern.
We will have a reasonable opportunity to inspect claimed workmanship issues and, where covered by an applicable agreement or warranty, determine an appropriate remedy.
23. Website Information
Information on the Site is provided for general informational and marketing purposes.
Project-specific pricing, specifications, timelines, materials, warranties, and obligations are determined by the applicable written estimate, proposal, contract, or warranty.
Website photographs and descriptions are illustrative and do not guarantee identical results for every property.
24. Intellectual Property
Unless otherwise indicated, the Site’s original text, graphics, design, photographs, branding, and other proprietary materials belong to or are licensed to St. Petersburg Pavers.
You may not reproduce or commercially exploit proprietary Site content without permission except as permitted by law.
25. Third-Party Services
Our Site or services may involve third-party suppliers, financing providers, manufacturers, websites, or other businesses.
We are not responsible for independently operated third-party websites or services except to the extent responsibility cannot lawfully be excluded.
26. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
PROJECT RESULTS MAY VARY BASED ON EXISTING PROPERTY CONDITIONS, MATERIAL CHARACTERISTICS, SOIL, DRAINAGE, WEATHER, MAINTENANCE, AND OTHER FACTORS.
NOTHING IN THESE TERMS ELIMINATES AN EXPRESS WRITTEN WORKMANSHIP OR PRODUCT WARRANTY PROVIDED FOR A PARTICULAR PROJECT.
27. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ST. PETERSBURG PAVERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE SITE OR SERVICES.
FOR CLAIMS ARISING FROM A PARTICULAR PROJECT, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT PAID TO US FOR THE PORTION OF THE PROJECT GIVING RISE TO THE CLAIM, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
28. Indemnification
To the extent permitted by law, customers agree to indemnify and hold harmless St. Petersburg Pavers and its owners, employees, and agents from third-party claims arising from:
- Incorrect information supplied by the customer;
- The customer’s lack of authority to authorize work;
- Undisclosed private utilities or property conditions;
- Customer-requested work that infringes another person’s property rights; or
- The customer’s violation of these Terms.
29. Force Majeure
We are not responsible for delays or failure to perform caused by events reasonably outside our control, including hurricanes, severe weather, flooding, governmental actions, labor or material shortages, supply-chain disruptions, utility interruptions, equipment failures, or similar circumstances.
30. Governing Law
These Terms and services are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Subject to applicable law, disputes will be brought in a court of competent jurisdiction in Pinellas County, Florida.
31. Severability
If a provision of these Terms is found invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
32. Changes to These Terms
We may update these website Terms periodically.
The current version will be posted on the Site with an updated revision date.
Changes to these general Site Terms will not retroactively alter a signed project contract unless agreed by the parties or permitted by law.
